Five questions left unanswered by the Mandelson files

Five Unresolved Questions Following the Release of the Mandelson Files

A second collection of documents concerning Lord Mandelson’s tenure as the UK ambassador to the United States was made public on Monday. This disclosure follows a February parliamentary vote to release the papers, with the intent of uncovering the private discussions surrounding his appointment to the post. The peer was dismissed from his position last year after US authorities revealed the depth of his association with Jeffrey Epstein, the late convicted sex offender.

The newly released materials comprise over 1,500 pages. However, several critical inquiries regarding his appointment remain unaddressed.

Which communications remain undisclosed?

The files include more than 160 pages of messages and WhatsApp exchanges between Lord Mandelson and various government ministers and officials. However, the peer refused to surrender his personal mobile device to investigators, meaning the contents of that phone were not included in the disclosure.

Furthermore, messages from Morgan McSweeney, the former chief of staff to Prime Minister Keir Starmer, are missing. McSweeney resigned after intense scrutiny regarding his involvement in advocating for Mandelson’s appointment. McSweeney stated that his government-issued phone was stolen last year and has never been recovered by police. Consequently, he could not provide all his communications, although it is believed he has submitted some messages sent to Lord Mandelson—potentially from his personal device—to the Cabinet Office.

Cabinet Office Minister Nick Thomas-Symonds also reported that his personal phone was stolen last year. He acknowledged that this device would have contained correspondence with the peer. While an ally of Thomas-Symonds indicated that he has shared recollections of these messages, the original texts are unavailable.

Additionally, some of the messages released by the government have been redacted to safeguard national security interests or protect diplomatic relations, leaving the content of those communications unknown.

Why did vetting experts advise against clearance?

The government confirmed that the Foreign Office granted Lord Mandelson security clearance for the position, despite recommendations to the contrary from United Kingdom Security Vetting (UKSV). Downing Street asserted that neither the Prime Minister nor any other minister was aware of this conflict at the time.

Previously, the Cabinet Office published a blank template of the UKSV vetting form, which featured three options—green, amber, and red—for officials to indicate their stance on granting clearance. However, the second batch of documents, published on Thursday, did not include a copy of Mandelson’s specific vetting form. Nor did it contain a nine-page document summarizing the vetting process, which is understood to exist.

How did Mandelson respond to due diligence inquiries?

A previous release of documents in March included a blank template sent to Mandelson to declare his interests. The second set of papers provided no further details on this matter. Notably, the completed declaration of interest form—which would have outlined conflicts of interest and any agreed-upon measures to address them—was not among the released materials.

What did Mandelson claim regarding his ties to Epstein?

Prime Minister Keir Starmer has previously alleged that Lord Mandelson failed to fully disclose the extent of his relationship with Epstein prior to his appointment. It was already known that during pre-appointment due diligence, McSweeney posed three follow-up questions to the peer concerning this relationship. However, Mandelson’s responses to these questions were not included in the Thursday release.

According to McSweeney, these documents are being withheld at the request of the Metropolitan Police, who are currently investigating Mandelson over allegations of misconduct in public office. Lord Mandelson has denied any wrongdoing. The BBC understands that Mandelson maintains he answered questions about his relationship with Epstein accurately during the vetting process.
